1. SUBJECT OF AGREEMENT
1.1. This Public Offer Agreement aboutrenderingservicesonbooking, gettingadvancepaymentfortransportationservicesandformingtraveldocuments, exchangeforms, ticketsandotherservices (further – Services) withthehelpofhttps://agent.!CybC[j;ltybt2/loginWebsite (further – Agreement), isenteredbetween“MOBILITY EU” LLC fromonepartandthe Customer, fromtheotherpart, togetherreferredtoastheParties.
1.2. Orderingservicesonthewebsite, the Customer agreeswiththeconditionsofthis Agreement.
1.3. “MOBILITY EU” LLCundertakestoprovidethe Customer withservicesonbookingseats, forming, salesoftraveldocuments, exchangeformsandotherservices, accordingtotheconditionsofthe Agreement, andthe Customer undertakestoacceptservicesandpayforthemat a fixedprice.
1.4. This Agreement, aswellasinformationonservices, whichisplacedontheWebsite, is a publicofferaccordingtoart. 633 oftheCivil Code ofPoland.
2. AGREED TERMS
2.1. Terms, appliedinthis Agreement havethefollowingmeaning:
2.1.1. Website – https://agent.!CybC[j;ltybt2/loginwebsite, whichwasdesignedwiththepurposeofrenderingservicesonbookingseats, formingandsalesoftraveldocuments, exchangeformsaswellasotherservicesrendering.
2.1.2. Administration\WebsiteOwner – “MOBILITY EU” limitedliabilitycompany, registeredandactingaccordingtothecurrentlegislationofPoland.
2.1.3. Customer – a full-aged, capablepersonusing a Website.
2.1.4. Personal data – dataorblockofdataaboutthe Customer, whoisidentifiedorcanbeidentified.
2.1.5. Personal dataOwner – Website Administration.
2.1.6. Processing ofpersonaldata – anyactionorsetofactionssuchascollecting, registration, accumulation, storage, adapting, change, update, application, deletionofpersonaldata, includingthosemadewiththehelpofinformation (automated) systems.
2.1.7. Booking a seat (severalseats) – ordering a seat (severalseats) in a businadvancewithpaymentdelayfordeterminedperiod.
2.1.8. Passenger – a person, providedwithservicesoncarriageby a vehicleandwhoisnotinvolvedindrivingit.
2.1.9. Carrier – a company, providingpassengerwithcarriageservices.
2.1.10. Busstation – a constructionattheroadtoservecitizens, passengersandcarriers.
2.1.11. Payer – a person, whopaysforservicesunderthe Agreement.
2.1.12. Ticket – a documentoftheestablishedform, whichconfirmsthefactofenteringinto Agreement.
2.1.13. Travel document – a documentoftheestablishedsample, whichgivesrighttotravelandis a carriageagreement, ismadeon a correspondingform, canalsobemadeinelectronicform.
2.1.14. Exchange blank – a document, whichgivesrighttoget a travelticketattheticketofficeof a busstationorrailwaystation.
3. RULES OF USING THE WEBSITE
3.1. The Customer mustreadthis Agreement andgivehis/herconsenttoitsconditionswhileordering Services ontheWebsite. The Customer giveshis/herconsentto Agreement conditionsbymeansofmarkingcertainfieldsoftheWebsitepages. As soonassuchconsentisgiven, the Agreement isregardedtobeconcludedandis a basiconeintherelationsbetween“MOBILITY EU” LLCandthe Customer/Payer.
3.2. UsingtheWebsitebythe Customer meansthatthe Customer completelyagreeswith:
3.2.1. Conditionsofthis Agreement;
3.2.2. Conditionsofsales, usageandreturnof Services, specifiedonthewebsiteandwhichcomplywiththecurrentlegislationofPolandandconditionsofCarriers.
3.2.3. Confidentialityconditions
3.2.4. Conditionsregardingthesuppressionofunlawfulacts.
3.2.5. Carriagerules.
3.3. In casethe Customer doesnotagreewiththeconditionsofthis Agreement, he/shemustleavetheWebsiteatonce.
3.4. The Customer\Payercanbookseats, buy a traveldocument, exchangeformororderotherservicesuponsigningupatthewebsiteorwithoutdoingso.
3.5. SigningupattheWebsitecanbecompletedthroughfillingin a correspondingform.
4. CONDITIONS OF TICKETS BOOKING, SALES AND OTHER SERVICES OF THE WEBSITE
4.1. In themomentofbookingseats, purchaseoftraveldocumentsorotherservicesontheWebsite, the Customer/Payergiveshis/herconsenttotheconditionsofthis Agreement andotherconditionsspecifiedonthewebsite.
4.2. In themomentofbookingseats, purchaseoftraveldocumentsorotherservicesontheWebsite, a Customer/Payergiveshis/herconsenttocollectandprocesshispersonaldatabytheWebsite Administration.
4.3. In themomentofbookingseats, purchaseoftraveldocumentsorotherservicesontheWebsite, the Customer/Payerundertakestospecifyhis/hertruepersonaldataordataofthePassengerthroughfillingin a correspondingform. In casethe Customer/Payer/Passengergivesfalsedatato“MOBILITY EU” LLC, the Customer/Payer/Passengercarriesresponsibilityforallcommercialrisks, whichcanoccur (ticketreturn, paymentofcostformakingchanges, placing a neworder, changeof a tariff, moneyreturnandsoon).
4.4. In caseofchangeofpersonaldataspecifiedincl. 4.3 the Customer/Payer/Passengerundertakestoinform“MOBILITY EU” LLCaboutsuchchangesimmediately. In casethe Customer/Payer/Passengerfailedtoinform“MOBILITY EU” LLCaboutsuchchanges, the Customer/Payer/Passengercarriesresponsibilityforallcommercialrisks, whichcanoccur (ticketreturn, paymentofcostformakingchanges, placing a neworder, changeof a tariff, moneyreturnandsoon).
4.5. As soonas a ticketbookingismadeontheWebsite, the Customer/Payerwillreceive a confirmationofsuchbookingtohis/here-mail. The abovementionedconfirmationcontainsthefollowinginformation: bookingnumber, date, timeandplaceofdeparture, route, period, duringwhichthe Customer/Payerhasrighttobuy a traveldocumentforthebookedseatandwayofpayment, therealsocanbeotherinformationspecified.
4.6. In casethe Customer/Payerbooked a seatbutfailedtopaythecostofthetraveldocumentduringthespecifiedperiod, suchbookingwillbecancelledautomatically. Therearenopenaltiesforcancelledunpaidbooking.
4.7. As soonasthe Customer/Payerbuys a ticket, he/shewillget a traveldocumenttoe-mailinelectronicform.
4.8. Travel documentconfirmsthefactofrenderingservicesby“MOBILITY EU” LLCtothe Customer.
4.9. The Payermakespaymentofticketcostaccordingtotariffsandin a wayspecifiedontheWebsite.
4.10. The Payergiveshis/herconsentforprocessingofhispersonalpaymentdata.
4.11. Website Administration hasrighttorefusetorenderservicestothePayeroraskfortheidentitycertificatecopyandidentificationcode (forresidents) of a bankcardowner, incasethereareenoughreasonstoconsider a transactiononthebankcard, withthehelpofwhichserviceswerepaidfor, anunlawfulone.
4.12. The Customer canbuyanexchangeformfrom“MOBILITY EU” LLC. To exchange a formfor a ticket, the Customer/PassengermustvisitBusstation/Railwaystationticketoffice. Form exchangeisfreeofcharge.
4.13. The Customer agreesthatuponsigningupattheWebsite, Administration willsendtotheCustomer’se-maillettersandnotifications, includingtheonesthathaveinformationofadvertisementkind. The Customer hasrighttorefusefromsuche-mailmarketing.
4.14. The Customer automaticallyagreestoreceivetextmessagesthathaveinformationofadvertisementkindfrom“MOBILITY EU” LLCtothephonenumberspecifiedonthewebsite. The Customer canrefusefromsuchmessagesbymeansofsending a specifiedtextmessage.
5. TICKET REFUND CONDITIONS
5.1. The Payerhasrighttoreturnmoneyforunusedtraveldocument.
5.2. A correspondingapplication, theformforwhichcanbefoundonthewebsiteandsentto“MOBILITY EU” LLCis a reasontoreturnmoney.
5.3. The applicationonmoneyreturnforunusedtraveldocumentmustcontainpersonaldataofthepersonwhomadepaymentoftraveldocumentcost.
5.4. In ordertoavoidpossibleunlawfulactionswhileforminganapplication, thePayermustpresent a copyofhispassportandidentificationcode, incase a personhasnoidentificationcodeduetohis/herreligiousconvictions, suchpersonmustpresent a copyofpassportpagewithsuchmark.
5.5. Fixing, takingandprocessingoftheapplicationisperformedbytheWebsite Administration from 9:30 a.m. till 7 p.m. onworkingdays, andfrom 10 a.m. till 5 p.m. ondaysoff.
5.6. Amounttobereturnedisestablishedineachcaseindividuallyby a Carrier, accordingtotheconditionsofrovidingservicesby a Carrier.
5.7. Money forunusedtraveldocumentwillbereturnedinthesamewayandaccordingtothesamepaymentdetailswithwhichtheticketpaymentwasmade.
5.8. AccordingtothecurrentlegislationofPoland, applicationscanbeconsideredwithin a monthperiod.
5.9. In ordertoreturnanexchangeformor a traveldocumentreceivedaccordingtosuchformbythe Customer/Payer/Passenger, thelattermustvisittheticketboxof a Busstation/Railwaystation.
6. CONDITIONS OF CONFIDENTIALITY
6.1. Anyinformationprovidedbythe Customer/Payer/Passengerunderthis Agreement duringbookingseats, purchase, returnoftraveldocumentsororderingotherservicesonthewebsite, includingbutnotlimitedtosurname, name, patronymic, identificationcode, phonenumber, e-mailaddress, bankdetails, etc. isregardedtobeconfidential.
6.2. The Customer/Payer/Passengergiveshis/herconsenttocollectandprocesspersonalinformationbytheWebsite Administration andbythepartnersof“MOBILITY EU” LLCinordertorenderhighqualityservicesunderthis Agreement.
6.3. The Website Administration guaranteesthatpersonaldataofthe Customer/Payer/Passengerwillbeusedonlywiththepurposeofrenderingservicesunderthis Agreement.
7. COPYRIGHT
7.1. All materialsplacedontheWebsitebelongto“MOBILITY EU” LLCoritspartners. All materialsarecopyrightedandprotectedbyintellectualpropertyrights, includingbutnotlimitedtoWebsitedesign, names, trademarks, logos, texts, rightsfordatabasesandotherelementsoftheWebsite.
7.2. The Customer doesnothaverighttocopy (completelyorpartially), spreadoruseinanyotherwayWebsitecontentorthemainprogramcodewithoutpreliminaryagreementwith“MOBILITY EU” LLC.
8. RESPONSIBILITY OF THE PARTIES AND DISPUTE SETTLEMENT ORDER
8.1. The Partiescarryresponsibilitiesunderthis Agreement accordingtothecurrentlegislationofPoland.
8.2. The Partiesagreedthatalldisputesoccurringunderthis Agreement shallbesolvedinanamicableway.
8.3. In caseitisnotpossibletosolve a disputeinanamicableway, thePartiesshallgotocourtaccordingtothecurrentlegislationofPoland.
8.4. In casethe Customer/Payer/Passengergivesfalseinformationto“MOBILITY EU” LLC, the Customer/Payer/Passengercarriesresponsibilityforallcommercialrisks, whichcanoccur (ticketreturn, paymentofcostformakingchanges, placing a neworder, changeof a tariff, moneyreturnandsoon).
8.5. In casethe Customer/Payer/Passengerfailedtoinform“MOBILITY EU” LLCaboutchangeofpersonaldata, the Customer/Payer/Passengercarriesresponsibilityforallcommercialrisks, whichcanoccur (ticketreturn, paymentofcostformakingchanges, placing a neworder, changeof a tariff, moneyreturnandsoon).
8.6. “MOBILITY EU” LLC doesnotcarryresponsibilityforviolationofthePassenger’srightby a Carrier. In caseofsuchviolation, thePassengermustsolvesuchissuesdirectlywith a Carrier.
8.7. In casethePassengerviolatesrulesofcarriage, rulesofcrossingthestateborder, normsofthecurrentlegislationofPolandorinternationallegalacts, a Carrierhasrighttorefuseprovidingcarriageserviceto a PassengerwithoutanycompensationoffundstothePassenger/Payer/Customer.
9. OTHER PROVISIONS
9.1. This Agreement comesintoeffectfromthemomentthe Customer gavehis/herconsenttothe Agreement andisvalidtillthemomentofcompletefulfilmentofobligationsunderthe Agreement bytheParties.
9.2. In casesnotforeseenbythis Agreement, thePartiesmustactaccordingtocurrentlegislationofPoland.
